1. Acceptance of Terms
By downloading, installing, or using the ChefBear application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and ChefBear ("we", "us", "our").

2. Service Description
ChefBear is an AI-powered mobile application that enables users to:
- Scan restaurant menus using your device's camera.
- Discover dishes with AI-generated descriptions, images, and dietary information.
- Receive personalized recommendations based on your stated dietary preferences and favourites.
- Save and organize favourite dishes and dining experiences.
The App is available in both free and premium subscription tiers. Certain features are available only to subscribers.

3. AI Content Disclaimer
Important Notice / Avis important
ChefBear uses artificial intelligence to generate dish descriptions, images, dietary labels, allergen indicators, and recommendations. This AI-generated content is provided for informational and entertainment purposes only and comes with the following limitations:
- AI-generated descriptions and images are approximations and may not accurately represent the actual dish as prepared by a specific restaurant.
- Dietary and allergen information generated by AI is not verified by the restaurant and should not be relied upon as the sole source of allergen or dietary information.
- AI-generated translations may contain errors.
- Always confirm allergen and dietary information directly with restaurant staff before ordering, especially if you have food allergies, intolerances, or medical dietary requirements.
ChefBear is not a substitute for professional medical, nutritional, or dietary advice. We disclaim all liability for decisions made based on AI-generated content.

4. Subscriptions & Auto-Renewal
4.1 Subscription Plans
ChefBear offers optional premium subscription plans that unlock additional features, including unlimited scans, advanced AI features, and more. Details of available plans and pricing are displayed in the App.
4.2 Auto-Renewal
Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Renewal charges will be applied to the payment method on file with Apple (via the App Store).
4.3 Cancellation
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as required by applicable law.
4.4 Price Changes
We may change subscription pricing from time to time. You will be notified of any price changes in advance, and the new price will apply at the start of the next billing period following the notice.
Abonnement et renouvellement automatique : Votre abonnement se renouvelle automatiquement à la fin de chaque période de facturation, sauf annulation au moins 24 heures avant la fin de la période en cours. Vous pouvez annuler à tout moment via les réglages de votre identifiant Apple. Aucun remboursement n’est offert pour une période partielle, sauf si la loi l’exige.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Interfere with or disrupt the App's servers, networks, or infrastructure.
- Scrape, harvest, or collect data from the App by automated means.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the App to transmit any malicious code, spam, or unauthorized advertising.
6. Intellectual Property
6.1 Our IP
The App, including all content, features, design, source code, algorithms, AI models, trademarks, logos, and documentation, is owned by ChefBear or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. All rights are reserved.
6.2 Your Content
You retain ownership of the photographs and content you create using the App. By using the App, you grant us a limited, non-exclusive, royalty-free licence to process your content as necessary to provide the service (e.g., sending menu images to AI providers for recognition). We do not claim ownership of your content.
6.3 AI-Generated Content
AI-generated descriptions, images, and recommendations produced by the App are provided for your personal use. You may not redistribute, sell, or commercialize AI-generated content without our prior written consent.

7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- We do not warrant the accuracy, completeness, or reliability of any AI-generated content, including dish descriptions, dietary labels, allergen indicators, images, or recommendations.
- In no event shall ChefBear, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App.
- Our total aggregate liability to you for all claims arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or CAD $50.00, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or death or personal injury caused by our negligence.
Limitation de responsabilité : L’Application est fournie « telle quelle » et « selon la disponibilité », sans garantie d’aucune sorte. ChefBear ne garantit pas l’exactitude du contenu généré par l’IA. Notre responsabilité totale est limitée au montant que vous nous avez versé au cours des 12 mois précédant la réclamation, ou 50 $ CA, le montant le plus élevé étant retenu.
8. Indemnification
You agree to indemnify, defend, and hold harmless ChefBear and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your infringement of any third-party rights.
9. Governing Law & Dispute Resolution
9.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles. If you are a resident of Quebec, the mandatory consumer protection provisions of Quebec law shall also apply.
9.2 Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the App, you agree to first attempt to resolve the dispute informally by contacting us at chefbearsupport@icloud.com. We will endeavour to resolve the matter within 30 days.
If the dispute cannot be resolved informally, you agree that any legal proceedings shall be brought exclusively in the courts of the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts. This does not prevent you from filing a complaint with the applicable privacy commissioner (see our Privacy Policy).
Loi applicable et règlement des différends : Les présentes conditions sont régies par les lois du Canada et de la province de l’Ontario. Si vous résidez au Québec, les dispositions impératives de la Loi sur la protection du consommateur du Québec s’appliquent également. En cas de différend, vous acceptez de tenter d’abord une résolution à l’amiable. À défaut, les tribunaux de la province de l’Ontario auront compétence exclusive.
10. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Intellectual Property), 7 (Limitation of Liability), 8 (Indemnification), and 9 (Governing Law).
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by other appropriate means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
12. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChefBear regarding the App.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Language: In the event of a conflict between the English and French versions of these Terms, the English version shall prevail, except where prohibited by applicable law (including Quebec language legislation).
Dispositions générales : Les présentes conditions, conjointement avec notre politique de confidentialité, constituent l’intégralité de l’entente. En cas de conflit entre les versions anglaise et française, la version anglaise prévaut, sauf là où la loi applicable l’interdit (y compris la législation linguistique du Québec).
