Before ordering or eating, confirm ingredients, allergens and cross-contact risks, meat/vegetarian/vegan status, and spiciness with the restaurant. Missing warnings do not mean a dish is safe. No recommendation or label replaces confirmation by the restaurant. Nothing in this notice limits rights or liabilities that cannot be limited under applicable law.

1. Acceptance of Terms

By downloading, installing, or using the ChefBear application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Awesome-Bears, Inc. doing business as ChefBear ("we", "us", "our").

2. Service Description

ChefBear is an AI-powered mobile application that enables users to:

• Scan restaurant menus using your device's camera.
• Discover dishes with AI-generated descriptions, images, and dietary information.
• Receive personalized recommendations based on your stated dietary preferences and favourites.
• Save and organize favourite dishes and dining experiences.

The App is available in both free and premium subscription tiers. Certain features are available only to subscribers.

3. AI Content Disclaimer

• AI-generated descriptions and images are approximations and may not accurately represent the actual dish as prepared by a specific restaurant.
• Dietary and allergen information generated by AI is not verified by the restaurant and should not be relied upon as the sole source of allergen or dietary information.
• AI-generated translations may contain errors.
• Always confirm allergen and dietary information directly with restaurant staff before ordering, especially if you have food allergies, intolerances, or medical dietary requirements.

ChefBear is not a substitute for professional medical, nutritional, or dietary advice. We disclaim all liability for decisions made based on AI-generated content.

4. Subscriptions & Auto-Renewal

4.1 Subscription Plans

ChefBear is free to download and use. The free plan includes a limited number of menu scans per day and 30 AI dish images per week. ChefBear also offers optional premium subscription plans (ChefBear Pro) that include unlimited scans and unlimited AI dish images. Unlimited features are subject to fair use: to keep the Service reliable for everyone, we may slow down or temporarily pause unusually heavy or automated use. Details of available plans and pricing are displayed in the App.

4.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Renewal charges will be applied to the payment method on file with Apple (via the App Store).

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as required by applicable law.

4.4 Price Changes

We may change subscription pricing from time to time. You will be notified of any price changes in advance, and the new price will apply at the start of the next billing period following the notice.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Scrape, harvest, or collect data from the App by automated means.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the App to transmit any malicious code, spam, or unauthorized advertising.
• Upload photos other than menu or food photos that you have the right to upload.

6. Intellectual Property

6.1 Our IP

The App, including all content, features, design, source code, algorithms, AI models, trademarks, logos, and documentation, is owned by ChefBear or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. All rights are reserved.

6.2 Your Content

You retain ownership of the photographs and content you create using the App. By using the App, you grant us a limited, non-exclusive, royalty-free licence to process your content as necessary to provide the service (e.g., sending menu images to AI providers for recognition). We do not claim ownership of your content.

6.3 AI-Generated Content

AI-generated descriptions, images, and recommendations produced by the App are provided for your personal use. You may not redistribute, sell, or commercialize AI-generated content without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We do not warrant the accuracy, completeness, or reliability of any AI-generated content, including dish descriptions, dietary labels, allergen indicators, images, or recommendations.
• In no event shall ChefBear, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App.
• Our total aggregate liability to you for all claims arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or CAD $50.00, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or death or personal injury caused by our negligence.

8. Indemnification

You agree to indemnify, defend, and hold harmless ChefBear and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your infringement of any third-party rights.

9. Governing Law & Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles. If you are a resident of Quebec, the mandatory consumer protection provisions of Quebec law shall also apply.

9.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the App, you agree to first attempt to resolve the dispute informally by contacting us at contact@awesome-bears.com. We will endeavour to resolve the matter within 30 days.

If the dispute cannot be resolved informally, you agree that any legal proceedings shall be brought exclusively in the courts of the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts. This does not prevent you from filing a complaint with the applicable privacy commissioner (see our Privacy Policy).

9A. Operational Data & Diagnostics / Données opérationnelles et diagnostics

ChefBear may automatically process only the minimum technical data reasonably necessary and permitted by Canadian law to operate, secure, and maintain the App, including app/device version, crash stack traces, failure categories, request timing, coarse network quality, security or abuse signals, and subscription-entitlement status. This excludes menu photos, OCR text, dish names, saved preferences, and conversations with ChefBear; it is not sold or used for advertising or profiling.

In addition to these diagnostics, the App sends non-sensitive in-app usage events to PostHog for product analytics; GA4 remains disabled. Product analytics never include menu photos or menu text and are not sold or used for advertising. They are off by default and run only if you turn on Settings > Share usage analytics (express consent); you can withdraw consent at any time by turning it off. Details appear in our Privacy Policy.

9B. Menu Photo Backup / Sauvegarde des photos de menu

When you are signed in to an international ChefBear account and recognize a menu, ChefBear privately backs up the menu photos of that scan to your account so that your menus are available on your signed-in devices. Backup as soon as you start recognition is being rolled out gradually; once it is available for your account, recognition can be completed or retried later, even if your connection drops or you close the app. Starting with app version 4.4.0, location and other EXIF metadata are removed from menu photos before upload. Backed-up photos are visible only to you and are not included in shared menu links.

Photos of a scan that is never recognized are deleted 365 days after that scan’s last activity; photos of a recognized menu are kept with that menu and follow its 365-day retention period. You can delete backed-up photos in the app at any time while you are online, except while your connection comes from mainland China. Photos taken as a guest or while signed out are not backed up automatically (see the Privacy Policy for limited exceptions, such as upgrading a guest account), and no menu photos are backed up while your connection comes from mainland China. Details of this processing and retention are set out in the “Menu photos, cloud menus and sharing” section of our Privacy Policy.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Intellectual Property), 7 (Limitation of Liability), 8 (Indemnification), and 9 (Governing Law).

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by other appropriate means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.

12. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awesome-Bears, Inc. doing business as ChefBear regarding the App.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Language: In the event of a conflict between the English and French versions of these Terms, the English version shall prevail, except where prohibited by applicable law (including Quebec language legislation).
