Welcome to ChefBear (the "App"). By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to any part of these Terms, please do not use the App.

AI-generated content, including dish descriptions, images, and nutritional information, is provided for reference only and may be inaccurate or incomplete. If you have food allergies or intolerances, always confirm directly with the restaurant. We accept no liability for any loss or damage arising from reliance on AI-generated content.
本應用程式及其所有內容（包括但不限於軟件代碼、用戶介面設計、圖形、標誌、商標及文字）均為 ChefBear 或其授權人的財產，受香港及國際版權法、商標法及其他知識產權法律保護。
閣下透過本應用程式上傳的內容（如菜單照片）的知識產權仍歸閣下所有。然而，閣下授予我們非獨佔、免版稅、全球性的許可，以使用該等內容向閣下提供及改善我們的服務。
本應用程式中由AI生成的內容（包括菜式描述及圖片）不構成閣下的知識產權。此類內容由AI模型基於訓練數據及閣下的輸入生成，其知識產權歸屬受適用法律規管。
閣下不得：
本應用程式的付費訂閱透過 Apple App Store 處理及管理。訂閱的購買、續費及取消均受 Apple 的條款及條件約束。
除非閣下在當前訂閱期結束前至少24小時取消訂閱，否則訂閱將自動續費。閣下可在 iOS 裝置的「設定」>「Apple ID」>「訂閱項目」中管理或取消訂閱。
所有退款要求均須透過 Apple 處理，並受 Apple 的退款政策約束。我們無法直接處理退款要求。
本應用程式可免費下載及使用。免費版每日可掃描菜單的次數有限，每星期可生成 30 張 AI 菜式圖片；ChefBear 進階版為可選訂閱，可無限次掃描菜單及生成 AI 菜式圖片。「無限」功能適用合理使用原則：為確保所有用戶的服務穩定，對異常高頻或自動化的使用，我們可能限速或暫時暫停。我們保留隨時修改免費功能範圍的權利。
Paid subscriptions are processed and managed through the Apple App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in iOS Settings > Apple ID > Subscriptions. All refund requests must be directed to Apple. The App is free to download and use: the free plan includes a limited number of menu scans per day and 30 AI dish images per week, and the optional ChefBear Pro subscription includes unlimited menu scans and unlimited AI dish images. Unlimited features are subject to fair use: to keep the Service reliable for everyone, we may slow down or temporarily pause unusually heavy or automated use.

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
在適用法律允許的最大範圍內：
To the maximum extent permitted by law, ChefBear shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the greater of HK$500 or the total amount paid by you for the App in the 12 months preceding the claim.
閣下同意就因以下事項而產生的任何索賠、損害、損失、責任及費用（包括合理的律師費），向 ChefBear 及其關聯方作出彌償並使其免受損害：
為提供、保障及維護服務，ChefBear 僅在法律允許範圍內自動處理合理必要且最少的技術資料，例如應用程式與裝置版本、崩潰堆疊、故障類別、請求耗時、粗略網絡品質、安全或濫用訊號及訂閱權益狀態。此等資料僅用於核心服務、可靠性、防欺詐及安全，不包括菜單影像、OCR 文字、菜式名稱、已儲存偏好或閣下與 ChefBear 的對話，亦不會出售或用於廣告或跨服務剖析。
除上述診斷資料外，本應用程式會把非敏感的應用程式內使用事件傳送至 PostHog 作產品分析；GA4 仍維持停用。產品分析絕不包括菜單影像或文字，亦不會出售或用於廣告。此功能預設開啟，閣下可隨時在「設定 > 分享使用統計」關閉。詳情請參閱私隱政策。
閣下登入國際區 ChefBear 帳戶並識別菜單時，ChefBear 會將該次拍攝的菜單照片私密備份至閣下的帳戶，以便閣下在已登入的裝置上使用菜單。開始識別後立即備份的功能正逐步推出；該功能適用於閣下的帳戶後，即使網絡中斷或閣下關閉應用程式，識別仍可稍後完成或重試。自應用程式 4.4.0 版起，照片上傳前會移除拍攝位置及其他 EXIF 元數據。已備份的照片僅閣下本人可見，亦不會包含在分享的菜單連結中。
始終未獲識別的照片會在該次拍攝最後一次活動後 365 天刪除；已識別菜單的照片隨該菜單保存，並依菜單的 365 天保存期限處理。閣下連線時可隨時在應用程式內刪除已備份的照片，惟網絡連線來自中國內地期間除外。以訪客身分或未登入時拍攝的照片不會自動備份（有限的例外情況，例如將訪客帳戶升級為正式帳戶，見私隱政策）；網絡連線來自中國內地期間，不會備份任何菜單照片。有關處理及保存期限的詳情，請參閱私隱政策中「菜單照片、雲端菜單與分享 / Menu photos, cloud menus and sharing」一節。
我們保留在以下情況下暫停或終止閣下使用本應用程式的權利，無須事先通知：
閣下可隨時透過刪除本應用程式來終止使用。終止後，本條款中按其性質應繼續有效的條文（包括知識產權、免責聲明、責任限制及管轄法律條文）將繼續有效。
我們保留隨時修訂本條款的權利。修訂後的條款將在本應用程式及我們的網站上公佈。如有重大變更，我們會透過合理方式通知閣下。閣下在修訂後繼續使用本應用程式，即表示同意受修訂後的條款約束。
We reserve the right to modify these Terms at any time. Material changes will be communicated through reasonable means. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
本條款受香港特別行政區法律管轄並按其解釋。
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
因本條款或本應用程式引起或與之相關的任何爭議，雙方應首先嘗試通過友好協商解決。如協商未能解決爭議，該爭議將提交香港特別行政區法院專屬管轄。
Any dispute arising out of or in connection with these Terms shall first be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
如本條款的任何條文被裁定為無效或不可執行，該條文將在必要的最小範圍內被修改或刪除，其餘條文將繼續完全有效。

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awesome-Bears, Inc. doing business as ChefBear regarding your use of the App.
